GENERAL TERMS.
We ask you to follow the rules that may exist in various areas you
go to on the Internet (this is generally referred to as "netiquette"). We
ask you not do anything that would harm our network or someone else's
network as a result of your actions. You are responsible
for the software you use, and for the charges you incur while you
are connected, including long distance or toll charges. Finally,
we agree to work with you to resolve disputes, but if we can not
agree on a solution, our liability is limited to the amount of your
current monthly charges. To assume greater liability
on our behalf would require us to charge higher rates for our service.

LAWFUL PURPOSES.
US Net services may only be used for lawful purposes. Transmission
or storage of any information, data, or material in violation of
any US or state law or regulation is prohibited. The
subscriber agrees to indemnify and hold harmless US Net from
any claims resulting from the subscriber's use of the service which
damages either the subscriber or another party or parties.
ROYALTIES, LICENSING, AND COPYRIGHTS.
The subscriber is responsible for following all rules and regulations
pertaining to the means by which the subscriber connects their terminal
or PC to US Net, including payment of software royalties,
if any, directly to authors. The Subscriber agrees to
abide by any and all software licensing and copyright restrictions.

PAYMENT.
Payment for US Net services is due in advance, and at monthly
intervals thereafter. Monthly service is not prorated. Payments
not made within 30 days are considered delinquent and may be subject
to reasonable collection and legal fees as well as interest accrued
at 1.5% per month, or the state legal limit, whichever is lower. Returned
checks are subject to a charge of $25.00. Credit card
subscribers agree to pay all billed amounts according to the card
issuer agreement.
US Net provides discounts from standard monthly charges for
advance payment on terms of one-year and two-years in length. If
such a advance payment plan is chosen and the account is closed
before the term of the plan expires, the charge for the partial
term will be recalculated based on the standard monthly charge in
order to determine the amount of the refund returned, if any.
US Net charges are for access to our network and/or the Internet
only, and do not include any charge for telephone, or telecommunications
access. All telephone and telecommunications charges
are the sole responsibility of the account owner. The
account owner is responsible for determining if any telephone or
communications charges will apply before accessing US Net. If
there is any question on this manner, queries should be directed
to the account owner's telecommunications access provider (such
as the local phone company). Under no circumstances
will US Net be responsible for charges on the customers bill
from the telephone company.

BILLING.
Unless the Monthly Billing via US Mail option is selected, subscriber
agrees to accept electronic transmission of bills through their
US Net email account.
FILES AND DATA.
US Net is not responsible for Subscriber's personal files
and data residing on US Net. For liability reasons,
US Net does not perform backups of subscriber home directories
or electronic mail. The Subscriber is responsible for
the independent archival and storage of the Subscriber's data that
is stored on US Net computers and networks. Subscriber
agrees that US Net has the right to delete any and all information
stored in the subscriber's account when the account is terminated,
for any reason, either by US Net or by the customer.

TECHNICAL ASSISTANCE.
US Net provides free technical support to subscribers using
the telephone, web, and electronic mail. This technical
support is intended to assist the customer with problems connecting
to the Internet through our service. US Net hires
only qualified technical support personnel to assist our customers,
and those personnel undergo continuous training in various engineering
and customer support areas. While unlikely, it is possible
that our assistance may actually make things worse and could possibly
result in the complete destruction of your computer, its operating
system, and all of the data stored on that computer. The
Subscriber agrees to accept full responsibility for any damage to
their computer or data while relying on technical assistance from
US Net. The subscriber also agrees to indemnify
and hold harmless US Net from any claims resulting from the
subscriber's use of US Net's technical support.

NON-TRANSFERABILITY.
US Net Personal accounts cannot be used by anyone other than
the subscriber. Subscriber certifies that he or she is
at least 18 years of age. It is the responsibility of
the subscriber to keep US Net informed in the event the subscriber's
mailing addresses is changed. US Net will cooperate
with law enforcement authorities if an account is opened under fraudulent
pretenses.

UNLIMITED DIAL-UP ACCOUNT RESTRICTIONS.
Unlimited personal accounts are for attended personal access ONLY. The
use of unattended servers, including web servers, IRC robots, FTP
servers, proxy-based routers is strictly prohibited. US
Net provides a separate service, called personal dedicated service,
that does allow unattended access. Personal accounts
can only send IP packets from or receive IP packets for the assigned
IP address. Dial-up accounts may use only one telephone
connection at a time. In the event Subscriber chooses
to make multiple simultaneous dial-up connections to US Net,
Subscriber agrees to pay additional charges based on the number
of simultaneous connections used. US Net reserves
the right to suspend or revoke service without advance notice if
we believe an unlimited personal dial-up account is being abused.

NETWORK CONTENT.
Subscriber understands that news groups, web pages, and other sources
of information may contain material unsuitable for children and
others due to their content. US Net does not monitor
or filter the content of information flowing through the network
unless US Net has reason to believe that the content violates
applicable United States laws, or is interfering with the normal
operation of the network.

CUSTOMER SECURITY.
The Customer is responsible for all use of their accounts and the
confidentiality of their passwords, including choosing safe passwords
and ensuring file protections are set correctly. US
Net will suspend access or change access to the Customer's account
immediately upon notification by Customer that the Customer's password
has been lost, stolen or otherwise compromised. US
Net is not liable for any usage and or charges prior to US
Net making the necessary account alteration. Customers
are reminded that no computer system can be considered as safe from
intrusion. Email may pass through many computer systems,
and should not be considered a secure means of communication unless
encrypted, and even encrypted information is only as secure as the
encryption method utilized.

UNACCEPTABLE CONDUCT.
The subscriber agrees to follow all acceptable use policies, which
may be modified from time to time. Subscribers are encouraged
to read the current acceptable use policies in effect by accessing
US Net's web site at http://www.us.net/support/acceptable
use.html. Any action on the behalf of the Subscriber
that causes US Net to encounter exceptional costs as a result
of their actions, including threats of law suits by Subscribers,
shall result in immediate termination of the Subscriber's service.

LIMITED WARRANTY.
US Net warrants that, if a subscriber is dissatisfied with
the service, US Net will, upon notification from the subscriber
to US Net, refund the service fees for the current month
and any prepaid fees for future months. Other than the
foregoing, no warranty is made by US Net regarding any information,
services, or products provided through, in connection with, or by
US Net, and US Net expressly disclaims any and all
warranties, including without limitation:
- any warranties as to the availability, accuracy, or content
of information, products, or services; and
- any warranties of merchantability or fitness for a particular
purpose.
LIMITED LIABILITY.
The liability of US Net, including without limitation any
liability for damages caused or allegedly caused by any failure
of performance, error, omission, interruption, deletion, defect,
delay in operation or transmission, communication line failure,
theft or destruction of or unauthorized access to, alteration of,
or use of records, whether for breach of contract, tortuous behavior,
negligence, or under any other cause of action, shall be strictly
limited to the amount paid by or on behalf of the subscriber to
US Net for the current month. NO ORAL ADVICE OR
WRITTEN INFORMATION GIVEN BY US NET, ITS EMPLOYEES, LICENSORS,
RESELLERS OR THE LIKE, SHALL CREATE A WARRANTY; NOR SHALL YOU RELY
ON ANY SUCH INFORMATION OR ADVICE.
ACCEPTANCE.
Use of a US Net account constitutes acceptance of these Terms
and Conditions.
